The Novell/Canopy/Caldera/DR DOS story continues, and Novell and Microsoft are in the middle of it all, battling in discovery in the Novell v. Microsoft Antitrust litigation -- that is the litigation over WordPerfect currently before the US District Court in Maryland in pretrial discovery . Microsoft politely asked for [PDF] all documents "relating to Novell's sale of PC operating systems claims to Caldera and Novell's involvement with Caldera's case against Microsoft", as well as "all documents produced by parties and third parties" in the Novell v. Canopy case. Why? Because it is its theory, which it wants to do discovery to demonstrate, that Novell sold all its Antitrust claims to Caldera, and that would kill off the two remaining claims Novell has brought against Microsoft in the Antitrust case. Microsoft, not satisfied with what Novell produced or its reasons for refusing to produce some documents, brought a Motion to Compel Discovery [PDF] [ Memorandum in Support (PDF)], and it has just been granted [PDF]. In Novell's opposition [PDF] to the motion, it attached some exhibits, one of which is the Settlement agreement [PDF] in the Caldera v. Microsoft litigation, as Exhibit K. Finally, we get to read it, all except the exact figure that Microsoft paid to Caldera. But Microsoft does say, in the memorandum in support, on page 9, that Novell got "tens of millions of dollars" from the Settlement, and a transcript [PDF] of a hearing ...

The two sides are back in court to argue the €899 million which the company was fined in February for violating a 2004 Antitrust Settlement. The Commission charged that Microsoft's plan to license out its code under the agreement was too expensive for most developers, therefore making the code inaccessible and placing the company in violation of the anti-trust agreement. The company said in a filing obtained by Reuters that it felt the EU's fine was unreasonable and excessive. "The Commission failed to take due account of the fact that the contested decision only concludes that the royalties allegedly established by Microsoft under one particular license," the company was quoted as saying. Microsoft also argued that its own evidence and arguments had not been properly heard before the commission made its decision to issue the first noncompliance penalty in its 50-year history. The EU did not issue an official statement on the matter, but a spokesperson was quoted by Reuters as saying that the Commission remained confident in its decision to fine Microsoft. ...

Hughes SHEPHERDSTOWN - State Attorney General Darrell McGraw's top aide spoke Friday about one of the office's more controversial cases. Chief Deputy Attorney General Fran Hughes said things went "very well" during Wednesday's hearing in Wheeling that delayed a possible $3.9 million payment to private attorneys hired by McGraw to sue Visa and MasterCard. Wednesday, Ohio Circuit Judge Ronald Wilson decided to consider an objection to the fees by a state legal reform group, West Virginia Citizens Against Lawsuit Abuse. The Settlement, with help from Gov. Joe Manchin and the state's Legislature, set up a sales tax holiday in September on appliances with the Energy Star label. "I think the reaction is that this is a very, very creative lawsuit," said Hughes, who was attending a meeting with McGraw's Citizen Advisory Committee. "It really showed what happens when you have a nonpartisan effort made on the part of the government." Attorneys who filed the suit also are campaign contributors of McGraw's. He has been criticized -- including by CALA Executive Director Steve Cohen -- for giving state contracts to supporters . At Wednesday's hearing, Wilson unexpectedly solicited testimony from Cohen, who identified himself as a watchdog and as a class member in the Antitrust suit. Section: Computers , Software / Applications Microsoft is facing yet another Antitrust investigation, this time from Taiwan. Their Fair Trade Commission is investigating whether Microsoft is monopolizing the island’s software market, and is also investigating whether the software giant is abusing that position. The agency launched its investigation after receiving numerous complaints about unfair pricing and the company’s decision to discontinue sales of Windows XP. “We fully intend to comply with the process and make sure they get all the information they need,” said Matt Pilla, Microsoft’s director of public relations in Asia. Should Microsoft be found guilt of the charges, they will face a fine of up to $797,361 and be forced to change it’s business practices in Taiwan. This is not the first time Taiwan’s Fair Trade Commission has taken aim at Microsoft. In 2004 they were involved in resolving disputes about Windows Media Player, and in 2003 reached a Settlement regarding the bundling of Microsoft Office. Drug company Abbott Laboratories Inc. agreed Wednesday to pay between $10 million and $27.5 million to settle an Antitrust lawsuit filed by AIDS patients over the company's 400 percent price hike of a popular HIV drug. The ultimate payout depends on the resolution in an appeals court of three technical legal questions, Abbott spokeswoman Melissa Brotz said.
