Psystar, the plucky Mac cloner in Doral, Fla,, has thrown down the gauntlet and countersued Apple. At a small press conference in the office of Psystar's attorneys in Palo Alto, Calif., the lawyers said they have answered Apple's original lawsuit filed July 3 and upped the ante by filing one of their own in a Northern California federal court. Psystar's View The countersuit filed Tuesday alleges that Apple is in violation of the Sherman and Clayton Antitrust acts. In particular, Psystar contends that Apple, by tying its Mac OS X operating system to Apple hardware, creates restraint of trade. Citing Microsoft and Linux as examples, Psystar attorney Colby Springer of the Antitrust law firm of Carr and Ferrell said these OS providers have no such restrictions on hardware. Psystar President Rudy Pedraza affirmed that his company believes Mac OS X is a great operating system, but customers shouldn't have to pay high hardware prices for what he termed "generic hardware." Psystar maintains it is giving customers a hardware alternative to Apple's Macintosh. Psystar's OpenPro Mac-compatible computer retails for about $1,600, half the cost of a similarly equipped Mac, while its entry-level Open Computer lists on the company's Web site for about $550. And here's what we found out: Department stores like Macy's, Bloomingdale's, Filene's, Lord & Taylor, Neiman Marcus, Nordstrom, and Saks Fifth Avenue cheated consumers by making a pact that they'd only sell cosmetic products at the suggested retail price. By doing so, there is no competition between stores, no discounts, and the consumer loses out. It's called price fixing, and it's a violation of Antitrust Laws, if you want to sound cool. Psystar is requesting that the court find Apple's EULA void, and is asking for unspecified damages. Psystar's attorneys are calling Apple's allegations of Psystar's copyright infringement "misinformed and mischaracterized". Psystar argues that its OpenComputer product is shipped with a fully licensed, unmodified copy of Mac OS X, and that the company has simply "leveraged open source-licensed code including Apple's OS" to enable a PC to run the Mac operating system. ...

Consumerworld tipped us off to a Wall Street Journal story about a Supreme Court ruling last year that allows manufacturers to set minimum prices for their products , and to require retailers to honor those prices. According to the article, companies in the same industry can't collude with each other to set prices --- that would violate Antitrust Laws --- but a business could stop working with a retailer who did not abide by those policies. Some companies allow stores to sell products for less as long as they don't publicize those lower prices. It's kind of the way that scratch'n'dent or salvage grocers work --- they often make agreements with their suppliers not to undermine sales at traditional markets and drug stores by advertising how low their prices are. But that kind of policy presents a challenge to online retailers, the WSJ article points out, because by their nature they alert consumers to prices in the market. ...

Once "unauthorized" Apple clone maker, Psystar, was sued by Apple, we fully expected it to challenge the legality of Apple's EULA (end user license agreement) which forbade putting the software on non-Apple hardware (a provision that even Apple has been known to ignore ). The comments to our post suggested that a more likely option would be for Psystar to claim that Apple was violating Antitrust Laws in requiring the software and hardware be bundled that way. Indeed, it looks like both of those predictions were correct. Psystar's response is likely to focus on both the legality of the EULA and whether or not Apple violated Antitrust law .
