The Environmental Protection Agency (EPA) is being sued for Age and race Discrimination in a class-action lawsuit pending before Equal Employment Opportunity Commission. The complainants allege that the EPA denied training opportunities, promotions, and other learning assignments to employees over the Age of 40 because of their Age and race, while granting preferential treatment, larger raises, expedited promotion, and opportunities to younger employees and recent hires. “The U.S. Environmental Protection Agency should be held accountable by compensating those employees who have been harmed by EPA’s unwritten and illegal policies of Age and race Discrimination,” said Steven M. Mult Scler. 2008 Aug 28; Authors: Mills RJ, Young CA, Nicholas RS, Pallant JF, Tennant A Background The 9-item, Fatigue Severity Scale (FSS-9) has been widely used as an outcome measure in multiple sclerosis (MS). Modern psychometric theory, in the form of the Rasch measurement model, has set new quality standards for outcome measures by appraising a broad range of measurement properties in addition to the reliability and validity emphasized by classical test theory. Objective To appraise the FSS-9 by application of the Rasch model. Method The FSS-9 was posted to patients with clinically definite MS in two centers in the United Kingdom. Analysis was based on 416 records (55% response). Results The 9-item scale failed to meet Rasch model expectations. Two items had poor Discrimination across the scale, and two further items showed bias for factors such as Age. Removal of these four items provided a valid 5-item Rasch scale that satisfied strict tests of unidimensionality. Conclusion Summating the nine items of the FSS-9 is invalid. Five items (FSS-5), which seem to be measuring the social impact of fatigue, provide a strictly unidimensional Rasch scale. Are all TV news presenters, women at least, required to be 30-somethings or younger? Some news execs appear to think so, according to papers filed with a London employment tribunal this week, at least (see two articles  here and here ). At one time, TV news presentation in Britain was dominated by 50-something white men. Almost all were grey-haired and buttoned up in jacket and tie (in the very early days it was dinner jacket required). No longer. Since the 1980s, the number of women and ethnic minority newsreaders in British newsrooms has grown. The average Age of presenters has fallen. Last month, veteran BBC interviewer Jeremy Paxman caused a storm in media circles after grumping, in an industry forum, that 'middle-class white males' have no future in television. An appeals court may have ended a long-running Age Discrimination battle between the town of Hull and a former disabled firefighter. The three-judge panel upheld a finding by the Massachusetts Commission Against Discrimination that said Donald Gillis should have been allowed to return to work in 1994 when a doctor found him fit to do so. The commission had awarded Gillis a little more than $174,000 for lost wages, emotional distress and lawyer’s fees, but the town appealed the finding through the courts. Gillis contended that he wanted to go back to work, but that Nicholas Russo, the fire chief at the time, did not allow him back because of his Age. Court documents said Gillis asked Russo at a town retirement board hearing in 1995 why he had refused to reinstate him. The chief replied, “I like you, Don, but I have to think of the town. I’ll get more bang for the buck by hiring a younger guy,” according to the documents. At the time, two vacant firefighter positions were available, which the town filled with men ages 30 and 32, the court record said. The commission had awarded Gillis $63,106 in lost wages, $50,000 in damages for emotional distress and $61,212 for lawyer’s fees. The court, however, reversed the commission’s order that the town turn over $94,760 to the Hull Retirement Board in repayment of retirement benefits the board had paid Gillis after he was not rehired. News that Selina Scott is set to sue Channel Five over ageism follows controversy when Carol Klein was not chosen as the new presenter of Gardener's World after previous presenter, Monty Don, stepped down after suffering a stroke. Scott has spoken out on ageism in broadcasting before and earlier this year commented, "How many women are there on mainstream current affairs programmes who are over 50?" she said. "Anna Ford has retired, Moira Stuart has been bumped, yet you look around and see lots of men." Scott was in the line-up of candidates to replace Natasha Kaplinsky on Five News when she went on maternity leave. The implication is clearly that producers feel women news readers should be 'totty' and that apparently translates as under 50. Kaplinsky will be covered by two younger news readers, one female and one male - and both young.   The Carol Klein issue may not be directly comparable as she was replaced by a younger male presenter, but you can't help suspecting that if she had been under 40 she might have stood a better chance of getting the job. If Scott continues with her claim it will be an interesting one to watch as it is very difficult for a claimant to prove that Age was the most important factor in an employer's selection decision.
