Yamana Gold Inc. should likely benefit from the miseries of the current credit crunch, with its ability to buy up companies that are financially less secure, says Scotia Capital analyst Trevor Turnbull. “Yamana’s core operations generate excess cash even under bearish scenarios,” he said in a note to clients. “In an environment where cash and credit are prized above all else, Yamana’s value should be self-evident.” His three top reasons for owning Yamana stock: Yamana is trading at less than five times estimated 2009 cash flow of $1.28 per share One-year growth of 43% and two-year growth of 54% is fully financed by cash flow. Yamana can buy and fund opportunities arising from the seized financing environment. While Mr. Turnbull is incorporating new lower base metal price forecasts into his analysis of the company, he says Yamana should still be able to generate $1.2-billion in net free cash flow through 2011. A redevelopment entity may authorize a redeveloper to negotiate directly with the owners of properties slated for condemnation under a redevelopment plan. This authorization may be granted by way of a redeveloper’s agreement with the condemning authority. The redeveloper should be aware, however, that it will be held to the same legal standards as the redevelopment entity. Additionally, a redeveloper must take care not to tie the hands of the condemning authority in making a good faith offer if, later, the redevelopment entity must institute formal condemn proceedings under the Eminent Domain Act of 1971.   For example, it would be unwise for a redeveloper to insert a provision in its redeveloper’s agreement with the redevelopment entity that allows the redeveloper to place a cap on just compensation or make settlement in excess of a specific purchase price contingent upon the redeveloper’s consent.
