The initial scuffle, first filed in 2010, claimed that Microsoft had infringed upon five of Motorola Mobility's patents. Four patents were dropped from the case during the course of the proceedings, the last remaining &lt;b&gt;patent&lt;/b&gt; covering peer-to-peer communication between wireless devices. Originally, ITC judge David Shaw ruled in favor of Motorola and subsequently recommended a ban on Xbox imports into the US. Then, in June of last year, the ITC remanded the decision back to the administrative law judge and asked him to take another look, effectively starting the process all over again. His second ruling, this time in favor of Microsoft, was delivered last March and will be the final word on the subject, now that the ITC has declined the opportunity to review his decision. Microsoft applied for a &lt;b&gt;patent&lt;/b&gt; that would reward users with achievements for doing things like watching the Super Bowl, or completing a full series of an entire show. Not surprisingly, Microsoft seems to think this could also carry over into better ad opportunities, where achievements could be tied to watching specific content, or doing things like rewarding you for owning a specific product and letting Kinect scan it. The complaint against Stephenville, Texas lawyer Jay Mac Rust represents the latest backlash against trolls, those lawyers who try to use their licenses to shake down targets with threatening-sounding letters that signify nothing. Earlier this month, a federal judge in California threw the book at Prenda , a law firm that had the clever idea of sending demand letters to people it suspected of downloading copyrighted porn movies. In a scathing ruling issued May 6 , U.S. District Judge Otis D. Wright ordered the attorneys at Prenda to pay $80,000 for abusing the legal system and said he was turning them over to state disciplinary authorities. Rust may find himself in a similar pickle if he isn’t careful. He didn’t immediately respond to a voicemail left on his cellular phone. In its complaint, Vermont says the 1999 University of Texas Law School grad sent letters to small businesses and nonprofits deliberately selected for their likely ignorance of &lt;b&gt;patent&lt;/b&gt; law. Rust represents MPHJ Technology Investments, a Delaware corporation that operates 40 shell companies that purportedly own patents on technology for integrating document scanners with computer networks. This would allow for racking up points when you watch certain shows, watch a certain amount of TV in a day, watch certain commercials, etc, followed by the obligatory showing-off to your friends of how much Arrested Development you managed to watch, despite the fact that the series is only available on Netflix. The specific examples Microsoft gives in the &lt;b&gt;patent&lt;/b&gt;? Watching specific events like the Super Bowl, or watching an entire series of a TV show. It also says that by incentivising television-watching, advertising opportunities would increase and revenue would go up for various companies. The added bonus of Kinect 2.0 also means that the system would know if you’re actually watching a show vs. just being in the room while it’s on, so you can’t cheat!
