Source: religionclause.blogspot.com --- Friday, May 24, 2013
Yesterday, in the most prominent of the many cases filed by small businesses challenging the Affordable Care Act contraceptive coverage mandate, an 8-judge en banc panel of the U.S. 10th Circuit Court of Appeals heard arguments in Hobby Lobby Stores Inc. v. Sebelius. In an unusual procedure the court previously decided to hear the case en banc without it first being heard by a 3-judge panel. (See prior posting .) While the 10th Circuit does not make audio recordings of oral arguments available, AP reported on the arguments. Hobby Lobby's attorney, citing the Supreme Court's Citizen's United case, argued that corporations have protected religious liberty rights. He said that Hobby Lobby is a "profit-making company, yes, but also a ministry." The Justice Department argued: "If you make an exemption for the employer, it comes at the expense of the employee" who is unable to get health care coverage. ...

As reported by the Associated Press (AP), the arts-and-crafts chain, which is based in Oklahoma City has requested that a federal appeals court grant the exemption citing businesses should be allowed to be excluded from that provision if it is violation of their religious beliefs. Susan Polan, associate executive director of the American Public Health Association, is quoted by the AP as stating of the case, “We’re talking about women’s access to reproductive health. That should be a decision between a patient and her health care provider, not a patient and her employer.” Justice News Flash delivers the latest in Denver legal news . The Oklahoma City-based arts-and-crafts chain argued that businesses — not just the currently exempted religious groups — should be allowed to seek exception from that section of the health law if it violates their religious beliefs. The arguments Thursday centered on the Green family, founders of Hobby Lobby Stores Inc. and a sister company, Christian booksellers Mardel Inc. An eight-judge panel peppered both sides with questions about whether the contraceptives mandate is an undue burden on the Greens’ religious belief. The Greens contend that emergency contraception is tantamount to abortion because it can prevent a fertilized egg from implanting in the womb. They also object to providing coverage for certain kinds of intrauterine devices. Hobby Lobby’s lawyer argued that the Greens shouldn’t face fines for not complying with mandatory contraceptive coverage simply because their business makes a profit. The stores are a “profit-making company, yes, but also a ministry,” Kyle Duncan argued. Read More at Newsmax . Full Appeals Court Hears Arguments in Hobby Lobby Contraceptive Coverage Case May 24, 2013 — The 10th U.S. Circuit Court of Appeals on Thursday heard the arguments from the federal government and retail chain Hobby Lobby over the company's request for an exemption from the federal contraceptive coverage rules, The Oklahoman reports (Bailey, The Oklahoman , 5/23). Normally, a three-judge panel hears appeals cases, but Hobby Lobby asked the entire panel to hear the case, and the court agreed. The court also granted Hobby Lobby's request to hear the case on an expedited basis because the company could begin incurring fines in July. The company is seeking an injunction to block the federal government from enforcing the contraceptive coverage rules, which require most health plans to cover contraceptive services. Hobby Lobby's Christian owners argue that the rules violate their religious beliefs because they consider some forms of contraception to be the equivalent of an abortion. Although the Obama administration has proposed an accommodation for religiously affiliated employers to ensure that they do not have to pay directly for contraceptive coverage, the accommodation was not extended to for-pr ...

The company has filed a lawsuit over whether or not the HHS Department can force it to comply with the mandate that compels it to pay for birth control and drugs that may cause abortions. The Becket Fund for Religious Liberty represented Hobby Lobby Stores before the an en banc hearing of the 10th Circuit Court of Appeals. World Magazine has more on how the hearing went: Although Hobby Lobby is a business, its founders’ faith permeates everything the company does, argued Kyle Duncan, one of the lawyers from The Becket Fund for Religious Liberty, which represents the Green family. The stores are a “profit-making company, yes, but also a ministry,” Duncan said. Today’s appearance before the full 10th U.S. Circuit Court of Appeals marks the third time the company has made its case in the courts. If it loses this round of its religious liberty fight, it will appeal to the U.S. Supreme Court. Lawyer Alisa Klein, arguing on behalf of the government, said allowing Hobby Lobby to avoid covering contraceptive devices it doesn’t like would in effect impose the Green’s religious beliefs on their employees: “If you make an exemption for the employer, it comes at the expense of the employee.” If it doesn’t comply with the law, Hobby Lobby faces fines o ...
