Yesterday, in the most prominent of the many cases filed by small businesses challenging the Affordable Care Act contraceptive coverage mandate, an 8-judge en banc panel of the U.S. 10th Circuit Court of Appeals heard arguments in Hobby Lobby Stores Inc. v. Sebelius. In an unusual procedure the court previously decided to hear the case en banc without it first being heard by a 3-judge panel. (See prior posting .) While the 10th Circuit does not make audio recordings of oral arguments available, AP reported on the arguments. Hobby Lobby's attorney, citing the Supreme Court's Citizen's United case, argued that corporations have protected religious liberty rights. He said that Hobby Lobby is a "profit-making company, yes, but also a ministry." The Justice Department argued: "If you make an exemption for the employer, it comes at the expense of the employee" who is unable to get health care coverage. ...

In the most prominent challenge of its kind, Hobby Lobby Stores Inc. asked a federal appeals court Thursday for an exemption from part of the federal health care law that requires it to offer employees health coverage that includes access to the morning-after pill. The Oklahoma City-based arts-and-crafts chain argued that businesses — not just the currently exempted religious groups — should be allowed to seek exception from that section of the health law if it violates their religious beliefs. The arguments Thursday centered on the Green family, founders of Hobby Lobby Stores Inc. and a sister company, Christian booksellers Mardel Inc. An eight-judge panel peppered both sides with questions about whether the contraceptives mandate is an undue burden on the Greens’ religious belief. The Greens contend that emergency contraception is tantamount to abortion because it can prevent a fertilized egg from implanting in the womb. They also object to providing coverage for certain kinds of intrauterine devices. Hobby Lobby’s lawyer argued that the Greens shouldn’t face fines for not complying with mandatory contraceptive coverage simply because their business makes a profit. Normally, a three-judge panel hears appeals cases, but Hobby Lobby asked the entire panel to hear the case, and the court agreed. The court also granted Hobby Lobby's request to hear the case on an expedited basis because the company could begin incurring fines in July. The company is seeking an injunction to block the federal government from enforcing the contraceptive coverage rules, which require most health plans to cover contraceptive services. Attorneys for Christian-owned craft store Hobby Lobby took on the Obama administration in court yesterday in its attempt to stop massive fines against it for not complying with the HHS mandate. The company has filed a lawsuit over whether or not the HHS Department can force it to comply with the mandate that compels it to pay for birth control and drugs that may cause abortions. The Becket Fund for Religious Liberty represented Hobby Lobby Stores before the an en banc hearing of the 10th Circuit Court of Appeals. World Magazine has more on how the hearing went: Although Hobby Lobby is a business, its founders’ faith permeates everything the company does, argued Kyle Duncan, one of the lawyers from The Becket Fund for Religious Liberty, which represents the Green family.
