The decision by a three-member panel of the 9th U.S. Circuit Court of appeals in San Francisco, which overturned the ruling of a federal district court judge, was hailed by abortion rights groups as a "huge victory" in a state they say has taken one of the nation's toughest stances on the issue. "Last year, Arizona led the nation in the number of legislative attacks against women's health care," Nancy Northrup, president of the Center for Reproductive Rights, said in a statement. "With today's defeat in federal court, we call on the governor and legislature to stop wasting Arizona taxpayers' time and money on these cruel and extremely harmful efforts to chip away at women's constitutionally protected rights," she said. A spokesman for Arizona Governor Jan Brewer, a Republican who signed the abortion ban into law in April 2012, said Brewer was disappointed in the ruling.             <description>&lt;p&gt;&lt;font color="Gray"&gt;Source: www.courthousenews.com --- Tuesday, May 21, 2013&lt;/font&gt;&lt;br /&gt;     (CN) -- Arizona cannot ban women from aborting pre-viable fetuses, the 9th Circuit ruled Tuesday.     The federal appeals court in San Francisco stuck down a controversial law passed last year that prohibited &lt;b&gt;Abortions&lt;/b&gt; in the state at or after 20 weeks, except in cases of a medical emergency.     Because the law "deprives the women to whom it applies of the ultimate decision to terminate their pregnancies prior to fetal viability, it is unconstitutional under a long line of invariant Supreme Court precedents," the three-judge appellate panel ruled.     A healthy fetus generally becomes viable at around 23 to 24 weeks.     After Arizona House Bill 2036 became law in April 2012, three doctors sued to stop it from going into effect. Paul Isaacson, William Clewell and Hugh Miller, with help from the ACLU of Arizona, won an emergency injunction , but lost a first round when U.S. District Judge James Teilborg rejected the claims that the ban would unconstitutionally strip women of their rights. Teilborg found, among other things, that the law was meant to regulate, rather than prohibit, abortion at and after 20 weeks because it included a medical emergency exception.     The appellate panel disagreed completely.     "Since Roe v. Mike Beebe's veto, the second-most restrictive abortion law in the nation was set to take effect Aug. 16.     U.S. District Judge Susan Webber Wright ordered the preliminary injunction after the American Civil Liberties Union and other groups sued to block the law, which passed the Arkansas Legislature in March.     Judge Wright issued the temporary block from the bench, after hearing arguments from both the ACLU and the Center for Reproductive Rights. The groups plan to press the court for a permanent injunction, the ACLU said.     "We have asked the court to stop this dangerous law from going into effect," the ACLU's Arkansas legal director Holly Dickson said in a statement. Congressman Trent Franks informed LifeNews today that he will advance legislation to provide protection nationwide for unborn children who have the capacity to experience pain while being aborted, a capacity defined in the bill as existing by 20 weeks fetal age. Franks is the prime sponsor of the Pain-Capable Unborn Child Protection Act. The current version of the bill, which garnered a majority vote in the House in 2012, would apply only to the District of Columbia. The congressman told LifeNews today that he intends to revise the bill (H.R. 1797) in committee to cover the entire nation in a bid to prevent more cases like that of Kermit Gosnell. As Chair of the House Judiciary’s Subcommittee on the Constitution and Civil Justice, Franks will hold a hearing on the legislation next Thursday. “I know when the subject is related in any way to abortion, the doors of reason and human compassion in our minds and hearts often close, and the humanity of the unborn can no longer be seen. But I pray we can at least come together to agree that we can and should draw the line at the point that these innocent babies can feel the excruciating pain of these brutal procedures,” he said.
