During the final hours of a marathon legislative session that concluded as the sun rose over the horizon July 1, state lawmakers approved two corporate tax hikes to help balance Delaware’s $3.3 billion budget. In the Senate, two House-approved tax increases spurred lengthy discussions, as legislators raced to pass a laundry list of bills and balance the budget on the final day of the legislative calendar. In the end, the Senate voted to increase the annual report fee for foreign corporations in Delaware from $60 to $100, and to raise the annual tax on limited liability companies and partnerships by 25 percent to $250. These measures are expected to raise $28 million and $24 million in 2009, respectively. Both bills had been passed by the House of Representatives last week, but met with mixed reviews from local business experts. Bob Symonds, a partner at the Wilmington law firm Stevens and Lee, testified in the Senate chamber that the increase could negatively affect the 550,000 limited liability companies in Delaware. “Part of what makes Delaware so special is its stability and its predictability and we accomplish that by having great laws and not taxing the business community,” he said. Symonds said taxes on limited liability companies already doubled in 2003.
