A Grand Island man who racked up four DUIs in three counties in a month has been sentenced in the last of his Hall County cases. Michael Van Boening, 24, was fined $400 and was sentenced to 60 days in jail. He was given credit for 180 days he has already spent in jail. He was also ordered not to drive for six months, 90 days of which will be an administrative driver's license revocation. He was scheduled to be sentenced Oct. 8, but he waived his right to presentence investigation and was sentenced in Hall County District Court Wednesday. The case stemmed from a Jan. 20 stop in Grand Island in which Van Boening was driving drunk with his then 8-month-old daughter in the vehicle. According to court documents, Van Boening had a blood alcohol content of 0.149. The legal limit for driving in Nebraska is 0.08. After a bench trial, Hall County District Judge William Wright found Van Boening not guilty of misdemeanor child abuse because there was reasonable doubt that he intentionally placed the child in peril of probable harm. However, he found Van Boening guilty of driving under the influence. The Jan. 20 arrest was the first of several for Van Boening. On Jan. 26, he was charged with misdemeanor child abuse when he left his daughter home alone. The case was dismissed by Hall County Judge David Bush and the girl is now in foster care.
