An Arlington resident who claims she was sexually assaulted by state Sen. James Marzilli, D-Arlington, last April is pursuing a criminal case against the lawmaker. On Monday, a request for a criminal complaint against the state senator was filed in Cambridge District Court, said Wendy Murphy, the victim’s spokesman and attorney. In April, Middlesex District Attorney Gerry Leone’s office investigated the accusation and decided not to charge Marzilli, citing a lack of evidence. Then, on June 3, Marzilli was arrested in Lowell and charged with annoying and accosting a person of the opposite sex, obstruction of justice, resisting arrest, disorderly conduct, simple assault and attempt to commit a crime to wit: assault and battery. According to Murphy, those charges point to a pattern of behavior and lend credibility to claims made by the Arlington woman in April. “The DA obviously got it wrong,” said Murphy. Leone’s office re-examined the report made in April after Marzilli’s arrest in Lowell, but could still not find enough evidence to press charges, said spokesman Corey Welford. “We took the allegations extremely seriously,” said Welford, who would not say what evidence was lacking, citing privacy concerns.
